Terms of Service

1. Who we are

The Service is provided by FoodCredit(“we”, “us”, “our”). You can reach us at foodcredit.io@gmail.com.

2. Eligibility and accounts

You must be at least 13 years old to create an account. You are responsible for the security of your credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

3. The Service

FoodCredit provides a loyalty, gift-card, and customer-engagement platform for restaurants and their customers. Features include points programs, milestone rewards, digital gift cards, promotional email and SMS, and customer analytics. We may change or discontinue features at any time.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose;
• Attempt to access accounts, data, or systems that do not belong to you;
• Send unsolicited commercial messages through the Service in violation of CASL, CAN-SPAM, the TCPA, or other applicable law;
• Reverse engineer, scrape, or interfere with the Service's normal operation;
• Misrepresent your identity or affiliation.

5. Restaurant operators

If you use the Service to operate a loyalty program for a restaurant, you are responsible for the lawful collection and use of customer data through the Service, for honoring rewards and gift-card balances you issue, and for the content of marketing messages you send.

6. Gift cards and points

Points and digital gift cards issued through the Service are redeemable only at the issuing restaurant and have no cash value. Refunds, expirations, and disputes related to a specific restaurant's rewards or gift cards are between you and that restaurant.

7. Termination

You may delete your account at any time from your account settings, or by contacting us at foodcredit.io@gmail.com. We may suspend or terminate accounts that violate these Terms.

8. Disclaimers

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, FoodCredit disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, FoodCredit will not be liable for indirect, incidental, special, or consequential damages arising out of your use of the Service.

10. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Ontario for any dispute arising out of these Terms.

11. Changes

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance.
